Landmark NGT Order Halting Illegal Sand Mining on the Brahmaputra

Challenge: A coalition of farmers and fishermen from Kamrup district approached us after years of illegal sand mining had destabilised riverbanks, destroyed agricultural land, and depleted fish stocks. Administrative complaints had gone unheeded for over three years. Our client group faced intimidation and lacked the resources to sustain prolonged litigation.

Outcome
The NGT issued a comprehensive order directing the immediate cessation of 14 unlicensed mining sites, ordered the district administration to file a compliance action plan within 60 days, and imposed environmental restoration levies. The order was subsequently cited in two subsequent NGT matters across the Northeast.

Reinstatement of Railway Employee After Wrongful Termination

Challenge: A senior railway technician was dismissed following a departmental inquiry conducted in violation of established procedural norms. The client had served 19 years without adverse remark and was a primary breadwinner. The inquiry officer's report contained factual contradictions, but the department had already issued the dismissal order.

Outcome
The CAT set aside the dismissal order, finding that natural justice principles had been materially violated during the inquiry. The client was reinstated with full back-wages covering a 26-month period and was deemed to have continued in service throughout the interregnum for purposes of seniority and pension calculation.

Writ Petition Securing Tribal Land Rights in Karbi Anglong

Challenge: A village community in Karbi Anglong faced displacement after an infrastructure project was approved without the mandatory gram sabha consent required under PESA. Notices had already been served and partial land acquisition had commenced before we were engaged.

Outcome
The Gauhati High Court stayed the acquisition proceedings and directed the state to conduct the gram sabha consultation afresh in compliance with the Panchayats (Extension to Scheduled Areas) Act. The stay resulted in a renegotiated process and significantly improved compensation terms for the community.

Recovery of Investment from Stalled Real Estate Project

Challenge: Forty-seven homebuyers had invested in an apartment project in Guwahati that remained undelivered for six years beyond the promised possession date. The developer had failed to register the project under RERA and had misrepresented occupancy certificate status. Our clients collectively stood to lose over ₹8 crore.

Outcome
Following parallel proceedings before RERA Assam and the Gauhati High Court, the developer was directed to either complete construction within an extended 18-month timeline under a court-supervised committee or refund all invested amounts with 10.75% annual interest. 39 of 47 buyers received full refunds within the prescribed period.

Child Custody and Relocation Order for NRI Parent

Challenge: An Indian mother residing in Canada sought custody of her two minor children who were retained in Guwahati by the estranged father following the breakdown of their marriage. The father had obtained an ex-parte injunction restraining the mother from taking the children abroad, and international jurisdiction questions complicated the matter.

Outcome
The Family Court awarded primary custody to the mother, incorporating structured visitation rights for the father including video access and annual vacation visits. The Gauhati High Court upheld the order in appeal, and the children were permitted to relocate to Canada with appropriate safeguards recorded in the decree.
